Terms of Service

1. Acceptance of these Terms

By creating an account or subscribing to BambooPrep, you agree to these Terms of Service. If you do not agree, do not use the service. These Terms form a contract between you (the parent or legal guardian) and Henry Huang trading as BambooPrep (ABN active from 21 May 2026, ASIC business name registration pending).

2. The service

BambooPrep is an AI-powered exam preparation platform designed for Australian families preparing children in Years 3-6 for the NSW Opportunity Class (OC) placement test, NSW Selective High School test, and private school scholarship exams. The service includes:

  • AI-generated practice questions calibrated to actual exam difficulty
  • Bilingual AI tutoring (English and Simplified Chinese)
  • Parent dashboard with child progress tracking
  • Personalised study plans based on performance data

We are not a private tutor, not an exam board, and not affiliated with the NSW Department of Education. Our AI-generated content is calibrated based on publicly released past papers but is not an exact reproduction.

3. Subscription, pricing, billing

BambooPrep offers tiered monthly subscriptions priced in Australian Dollars:

  • Basic — A$19/month (1 child)
  • Pro — A$39/month (up to 2 children)
  • Premium — A$79/month (up to 4 children)

Prices may change with 30 days' notice. New customers receive a 7-day free trial; you can cancel before the trial ends without being charged. After the trial, subscriptions auto-renew monthly until cancelled.

Cancellation: You may cancel at any time from your Account settings. Cancellation takes effect at the end of the current billing period; you retain access until then. We do not provide pro-rata refunds for unused days in a paid month, except where required by law.

Refunds: If you cancel within the first 7 days of a paid month and the cancellation is due to a service failure on our part, we will provide a full refund. This is in addition to (not in place of) your statutory consumer guarantees.

4. Acceptable use

You agree NOT to:

  • Share your account credentials with anyone outside your immediate household
  • Use the service to commercially redistribute generated questions
  • Scrape, reverse-engineer, or attempt to extract our prompts or training data
  • Use the service to harass, impersonate, or harm others
  • Upload illegal content of any kind
  • Use the service for any child under your account who is not your own child or under your legal guardianship

Violation may result in suspension or termination without refund.

5. AI-generated content disclaimer

BambooPrep's practice questions, explanations, and AI tutor responses are generated by large language models (currently Anthropic Claude). While we apply multiple validation layers, AI output can contain errors, ambiguities, or unusual phrasings.

You acknowledge that:

  • AI-generated content is not a substitute for a qualified teacher or tutor
  • You should verify important answers with your child's school or tutor
  • We do not guarantee that practising on BambooPrep will result in a successful exam outcome — exam success depends on many factors outside our control
  • Errors discovered should be reported to us — we maintain a public errata log

6. Consumer guarantees (Australian Consumer Law)

Our services come with non-excludable consumer guarantees under the Australian Consumer Law (ACL), Schedule 2 of the Competition and Consumer Act 2010 (Cth). We guarantee that:

  • Our services will be provided with due care and skill
  • Our services will be reasonably fit for the purpose we describe
  • Our services will be supplied within a reasonable time

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee that cannot lawfully be excluded. If we fail to meet a consumer guarantee, you may be entitled to remedies under the ACL.

7. Limitation of liability

Subject to your non-excludable consumer guarantees:

  • Our maximum aggregate liability to you for any claim is limited to the total subscription fees you have paid in the 12 months preceding the claim
  • We are not liable for indirect, consequential, or special damages (such as loss of opportunity, emotional distress unrelated to a privacy breach, or loss of profit)
  • We are not liable for failures caused by your own actions, third-party services beyond our control, or force majeure events

8. Children's privacy and consent

By registering, you confirm that you are the parent or legal guardian of any child for whom you create a profile, that you are 18 years of age or older, and that you consent on behalf of your child to our collection and processing of their data as described in our Privacy Policy.

You agree to comply with our Parental Gate flow during sign-up and to update consent when your child reaches age 15 (in line with the OAIC Children's Online Privacy Code).

9. Suspension and termination

We may suspend or terminate your account if you breach these Terms, attempt fraud, or use the service in a way that harms others. Upon termination, we will retain your data for 30 days to allow account recovery, after which it is permanently erased unless legally required to retain it longer.

10. Governing law

These Terms are governed by the laws of New South Wales, Australia. You and we agree to submit to the non-exclusive jurisdiction of the courts of New South Wales.

If you are a consumer for the purposes of the Australian Consumer Law, you retain all rights to bring action in any court that has jurisdiction in your state or territory.

11. Changes to these Terms

We may update these Terms from time to time. Material changes will be notified by email and an in-app notice at least 30 days before they take effect. Your continued use of the service after that period constitutes acceptance.
